A 12-year-old San Diego boy is recovering from a broken leg he sustained after he was injured in a bicycle accident caused by a hit-and-run driver.
According to San Diego police, the boy, whose name has not been released, was riding his bicycle along National at 37th Street around 6:00 p.m. on Christmas Eve. The boy reportedly rode his bicycle into the street directly into the path of a car traveling southbound. The car struck the boy, shattering his tibia and fibula. He was transported to a local hospital to receive treatment for his injuries but not before the driver of the car fled the scene.
San Diego police are looking for the driver of the car, who will be charged with felony hit-and-run, even though the boy was technically at fault in causing the collision. Anyone who witnessed the accident or has information about the driver of the car is urged to contact the San Diego police department at (619) 531-2000.
The victim in this case is fortunate that the injuries he sustained were not more serious. According to the National Highway Traffic Safety Administration, there were 630 bicycle accident deaths on U.S. roadways in 2009. Of those deaths, 99 occurred in California alone. Seventy-four of the bicyclists killed nationwide were under age 14. While California has some of the strictest bicycle helmet laws in place, millions of bicyclists suffer injuries in accidents each year.
Hopefully, the victim's leg will heal quickly and he will not require extensive surgery or physical therapy to correct the damage caused by the accident. Had the driver of the car been at fault in causing the collision, the boy's family may have had grounds for a personal injury claim for damages. Under California law, negligent motorists may be required to pay compensation for medical bills, lost wages and pain and suffering if they are proven responsible for causing injury to another driver, pedestrian or bicyclist.
